To qualify for Social Security disability benefits, you must first have earned a sufficient number of work credits during your work career. Having a medical and or mental condition that meets Social Security's definition of disability is necessary. Social Security pays monthly cash benefits to people who are unable to work for a year or more because of an approved disability.
WHO IS ELIGIBLE FOR SUPPLEMENTAL SECURITY INCOME - SSI
To qualify for Supplemental Security Income, you must have limited income and resources as per Social Security guidelines, and you must be a child or adult who is blind, disabled, or 65 years of age or older. You must live in the United States and be a U.S. citizen or an eligible non-citizen.
NOTE: Under SSI, a child is defined as being unmarried, under age 18, or under age 22 and in school or other training to prepare for a job.
APPEAL YOUR SSD/SSI DECISION:
It is not unusual for a number of persons who go through the process of applying for Social Security or SSI disability will be denied the first time. That's usually 8 out of 10 people who will be denied the first time they apply for SSD or SSI benefits. The chances of getting approved for benefits usually go up for those who take the time to appeal. More specifically, getting a case at a hearing in front of an Administrative Law Judge (ALJ) is where a claimant will have his/her best opportunity at winning disability benefits.
If your disability claim has been denied, you need to understand how the appeals process works. You have little chances of winning disability benefits if you don't appeal the initial denial and know the steps to take to win the appeal. That's where Stewart J. Diamond, Esq., Attorney at Law will work on your behalf to appeal your case. You have 60 days from the time of your denial to submit an appeal claim. Don't hesitate to make the decision to get help in filing an appeal.. Time is a factor. Call Mr. Diamond today.
